Welcome to the studio of Justina Freel. These Terms of Service (“Terms”) govern your access to and use of www.justinafreel.com (the “Site”), all purchases made through the Site, and all related services provided by Justina Freel (“the Studio,” “we,” “us,” or “our”). By visiting the Site, purchasing art, or commissioning a bespoke piece, you agree to these Terms in full. If you do not agree, you may not use the Site.

Eligibility

You must be at least 18 years old and legally able to enter into binding agreements
to use the Site or make any purchase.

Intellectual Property

All art, images, text, designs, graphics, digital downloads, packaging designs, and all other studio materials are the exclusive intellectual property of Justina Freel and are protected by U.S. and international copyright, trademark, and design laws.

Nothing purchased grants reproduction rights, commercial rights, distribution rights, or the right to create derivative pieces.
Any unauthorized use is strictly prohibited and may result in legal action.

Shop Purchases

By placing an order for any shop edition or original, you agree that:

  • Prices are listed in U.S. dollars and may be updated at any time.

  • Payment is due at checkout; orders are not accepted until payment clears.

  • Once an order enters fulfillment, it cannot be altered or canceled.

  • Studio availability, edition quantities, and release schedules may change without notice.

The Studio reserves the right to decline or cancel an order for any reason, including suspected fraud or misuse of the Site.

Bespoke Commissions

Bespoke commissions begin with an Inquiry Submission. Acceptance of an inquiry is at the sole discretion of the Studio. If the project is accepted, the first step is the Concept Visualization Consultation, a $500 creative-development phase that establishes artistic direction, scale, materials, timeline, and all essential design considerations.

The $500 consultation fee is non-refundable and is applied in full to the final purchase should you proceed.

At the completion of this phase, the Studio will provide a detailed Acquisition Agreement, outlining the full investment, production schedule, material specifications, framing details, and delivery expectations for your bespoke piece.

A commission becomes binding—and the Studio formally begins creation—once the Acquisition Agreement is signedand the initial payment specified in that Agreement has been received.
At that point, the commission is non-cancelable, non-returnable, and non-refundable, reflecting the highly tailored nature of the artistic process and the custom materials sourced for each client.

All terms specific to creation, payments, timing, adjustments, and delivery are governed by the Acquisition Agreement and supersede these general Terms for bespoke projects.

Shipping

Shipping timelines, insurance, packaging, and international customs obligations are described on the Shipping Page, which is incorporated into these Terms by reference.

Risk of loss transfers to the client upon carrier acceptance. All parcels are insured; clients must retain packaging for any claim.

Returns & Exchanges

Due to the fragile, archival nature of art, and the custom packaging required to protect dimensional silhouettes, mineral-pigment surfaces, and originals, all sales are final.
There are no returns, exchanges, or refunds, with the sole exception of carrier-verified damage occurring in transit, as outlined in the Shipping Page.

Payment Processing

Payments are processed by trusted third-party processors. By making a purchase, you authorize the processor to charge your selected payment method.
The Studio is not responsible for errors, delays, chargebacks, or security issues arising from third-party processors.

Privacy

Your personal information is governed by our Privacy Policy, which forms part of these Terms.
By using the Site, you consent to the collection and use of information as described therein.

Prohibited Conduct

You agree not to:

  • interfere with Site functionality or security

  • attempt unauthorized access to servers, data, or accounts

  • use the Site for fraudulent, unlawful, or harmful purposes

  • use automated systems (scrapers, bots, crawlers) without explicit consent

  • publish, reproduce, distribute, or misuse any copyrighted studio materials

Any violation may result in immediate termination of access and potential legal action.

Availability of the Site

The Studio may modify, suspend, or discontinue the Site, releases, or offerings at any time without notice.
We are not liable for interruption, delay, or loss of access.

Disclaimer of Warranties

The Site and all offerings are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties—express or implied—including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and accuracy.

Limitation of Liability

To the maximum extent permitted by law, the Studio, its owner, and its representatives shall not be liable for:

  • indirect, incidental, punitive, exemplary, or consequential damages

  • loss of profits, data, use, goodwill, or business opportunity

  • damages exceeding the amount you paid for the specific item or service giving rise to the claim

Certain jurisdictions may not allow these exclusions, so some limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless the Studio and its representatives from any claims, damages, liabilities, losses, or expenses (including legal fees) arising from:

  • your breach of these Terms

  • your use or misuse of the Site

  • your violation of any third-party rights

Governing Law

These Terms are governed by and interpreted under the laws of the State of California, without regard to conflict-of-law principles.
Any dispute shall be resolved exclusively in state or federal courts located in Los Angeles County, California, and you consent to that jurisdiction.

Changes to the Terms

The Studio may update these Terms at any time. Updates become effective upon posting to the Site. Continued use constitutes acceptance.

Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in effect and fully enforceable.
