I. THE PREAMBLE

Welcome to the studio of Justina Freel. These Terms of Commission (“Terms”) govern your access to the digital sanctuary of www.justinafreel.com (the “Site”), all collections acquired through the Site, and the bespoke services provided by Justina Freel (“The Studio,” “we,” “us,” or “our”). By visiting the Site, acquiring a collection, or commissioning a bespoke heirloom, you agree to these Terms in full.

II. ELIGIBILITY

The Studio accepts commissions exclusively from patrons who are at least 18 years of age and possess the legal capacity to enter into binding agreements.

III. INTELLECTUAL PROPERTY

The Artist’s Right All artwork, silhouettes, imagery, text, designs, graphics, and the "Sacred Union" methodology are the exclusive intellectual property of Justina Freel. They are protected by U.S. and international copyright, trademark, and design laws.

The Patron’s Usage The acquisition of an artwork—whether a Shop Edition or a Bespoke Commission—grants the patron the right to display the physical work for personal enjoyment. It does not grant reproduction rights, commercial rights, distribution rights, or the right to create derivative works. Any unauthorized use is strictly prohibited and will be pursued to the fullest extent of the law.

IV. STUDIO ACQUISITIONS

By placing an order for any Studio Edition or Original, you acknowledge that:

Prices are listed in U.S. Dollars and are subject to change based on market valuation. Payment is due at the time of reservation; orders are not confirmed until payment clears. Once a work enters the fulfillment queue, it cannot be altered or canceled. The Studio reserves the right to decline an order for any reason, including the protection of the artist’s limited availability.

V. THE BESPOKE COMMISSION

The Initiation Bespoke commissions begin with an Inquiry Submission. Acceptance is at the sole discretion of the Studio. If accepted, the process initiates with a $500 Design Deposit. This non-refundable retainer secures your placement in the Studio Season and funds the creation of your Atelier Bespoke Sample Box.

The Commission Agreement Upon approval of the design direction, the Studio will issue a Commission Agreement, outlining the full investment, production schedule, material specifications, and framing details.

The Commitment A commission becomes binding—and the Studio formally begins creation—once the Commission Agreement is signed and the initial payment has been received. At that point, the commission is non-cancelable, non-returnable, and non-refundable, reflecting the highly tailored nature of the "Slow Art" process and the custom materials sourced for each patron.

All terms specific to creation, payments, timing, and delivery are governed by the Commission Agreement, which supersedes these general Terms for bespoke projects.

VI. SHIPPING & RELEASE

The Transfer of Care Shipping timelines, insurance, and international customs obligations are detailed on the Shipping Page, which is incorporated into these Terms by reference. The risk of loss transfers to the patron upon carrier acceptance. All parcels are fully insured; patrons must retain all original packaging to facilitate any necessary insurance claims.

VII. RETURNS & EXCHANGES

The Finality of the Art Due to the fragile, archival nature of the work and the custom packaging required to protect dimensional silhouettes, all sales are final. There are no returns, exchanges, or refunds, with the sole exception of carrier-verified damage occurring in transit.

VIII. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Studio shall not be liable for indirect, incidental, or consequential damages, including loss of profits or data. The Studio’s total liability for any claim arising out of these Terms or the use of the Site shall not exceed the amount paid by you for the specific artwork or service giving rise to the claim.

IX. GOVERNING LAW

These Terms are governed by the laws of the State of California. Any dispute shall be resolved exclusively in state or federal courts located in Los Angeles County, California, and you consent to that jurisdiction.

X. SEVERABILITY

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in effect and fully enforceable.
